1. Introduction

1.1 Root Support Academy, with its registered office at #1031/B, 2nd Floor, Panchamantra Road, Opposite SBI Bank, Gnana Ganga School Road, Kuvempunagar, Mysore - 570023 (hereinafter referred to as "Root Support Academy," "we," "us," or "our"), offers online coaching classes for various competitive entrance exams. These include Banking, State Selection Commission, State Public Service Commissions, Railway, and Insurance sectors, among others. Our courses and services (the "Services") are available through our official website, www.rootsupportacademy.com, as well as other platforms that we may notify from time to time. Additionally, the Services can be accessed via software for personal computers and mobile applications (collectively, the "Applications").

By accepting these Terms of Service, you enter into a binding contract with Root Support Academy.

1.3 All individuals accessing our Site, Applications, and Services (referred to individually as "User" and collectively as "Users," "you," or "your") are requested to carefully review these Terms of Service. These terms contain important information regarding your legal rights, obligations, and remedies. If any student experiences such behavior during online education classes—whether from another student, a tutor, or any teaching or non-teaching staff—they have the right to submit a written complaint to Root Support Academy on their behalf.

2.2 Root Support Academy will address such complaints promptly and in accordance with the law. While students may request anonymity when filing a complaint, they should understand that this may limit the Academy’s ability to take action. To enroll, users must register and create an account.

4.2 Enrollment in Courses and use of Services are subject to the following conditions:

4.2.1 Providing accurate, current, and complete information, including valid contact details.

4.2.2 Ensuring that your device/hardware is compatible with the Site/Application. You are responsible for maintaining compatibility and security, and Root Support Academy is not liable for any related issues.

4.2.3 Adherence to these Terms of Service at all times.

4.3 You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. Any activity performed under your account is deemed to be your responsibility. Root Support Academy is not liable for any unauthorized access to your account, including any resulting losses. Providing false or inaccurate information may lead to the suspension of your account and termination of services.

4.4 The Site, Application, and Services are strictly for educational purposes. We provide access to educational information and related resources on an "as is" basis. While we strive for accuracy, we assume no liability for errors, completeness, or currency of the information provided. Free content or educational materials derived from third-party sources may also be available, for which we assume no responsibility.

4.5 All intellectual property, including content, copyrights, trademarks, and trade names, belong to Root Support Academy or credited third parties. Accessing the Site/Application does not grant any rights to users. Some content may be encrypted and viewable only through the Site/Application, prohibiting downloads or unauthorized access.

4.6.4 Unauthorized access attempts, such as hacking or password mining, are strictly prohibited.

4.7 Root Support Academy provides an online platform for Courses and Services by engaging third-party subject matter experts ("SMEs"). We do not control or assume responsibility for the actions, omissions, or negligence of SMEs. By using the Site/Application/Services, you acknowledge that Root Support Academy is not liable for any issues arising from SMEs' actions.

4.8 Courses may include live sessions conducted by SMEs at scheduled times. Access is available only during the scheduled slots. If you miss a session, it is at your own risk. SMEs may alter schedules due to contingencies, and Root Support Academy's role is limited to communicating these changes.

4.9 Course content aligns with curriculum guidelines but is intended as a supplement to formal education, not a replacement.

4.10 Neither we nor the SMEs guarantee specific outcomes in exams or career advancements. We make no assurances regarding the quality, accuracy, or adequacy of the provided information.

4.11 We reserve the right to remove, edit, or delete user-posted content at any time. The Site/Application interface may also change at our discretion.

4.12 Users are solely responsible for any content they upload to the Site/Application, even if used as part of our Services.

4.13 The Site/Application may contain links to third-party services, including payment gateways and financing providers. Users must review and accept the respective terms before use. Root Support Academy is not responsible for any issues encountered with third-party services.

4.14 All users, including SMEs, are bound by these Terms of Service.

4.15 We reserve the right to monitor the download, access, and usage of the Site/Application.

4.16 Any feedback or information provided by users shall be deemed non-confidential and may be used by us freely. By submitting feedback, you acknowledge that:

(i) It does not contain confidential or proprietary information.

(ii) Root Support Academy has no obligation to maintain confidentiality.

(iii) Similar ideas may already be in development.

(iv) No compensation is owed for submitted feedback.

4.17 Root Support Academy is not responsible for any content provided by users or third parties.

5. Cookies

5.1 Cookie Usage

6. Payment Terms

6.1 The User shall make the following payments to Root Support Academy:

a. Course Expenses – These cover costs for study materials, e-books, ID cards, app access, and other related items, which will be itemized by Root Support Academy at the time of collection.

b. Course Fees – These are the fees for attending the Course, including any additional fees for add-on courses or other applicable charges notified by Root Support Academy.

6.2 Course Fees and Course Expenses are ordinarily payable in full before the Course begins. Failure to make payment will result in the User being denied access to the Course. For certain Courses, Users may opt to pay the Course Fees in installments, subject to the terms and conditions of the installment scheme notified by Root Support Academy. In such cases, "Course Fees" will include all installments and any applicable late fees for delayed payments.

6.3 Upon acceptance of a duly completed enrollment request, the User must choose between lump sum or installment payment and indicate their choice in writing. The full Course Expenses and Course Fees (or the applicable installment) must be paid using one of the following methods:

6.3.1 Domestic and international credit cards issued by banks and financial institutions under the Visa, Mastercard, and Amex networks.

6.3.2 Visa and Mastercard Debit cards.

6.3.3 Net banking/Direct Debit payments from select banks in India.

6.3.4 Payment wallets.

6.3.5 Any other methods provided by the Payment Gateway service provider (collectively, the "Payment Methods").

6.4 The User’s access to the Application/Site is subject to timely payment of the Course Fees, including installments, if applicable. In case of default or non-payment, Root Support Academy may disable or restrict the User’s access without prior notice. It is the User's responsibility to ensure payments are made on time.

6.5 The Course Fees stated on the Site/Application are final, non-negotiable, and non-refundable except as expressly provided in Clause 7.

6.6 Payments made via any Payment Method will be processed through a third-party payment gateway. Upon successful payment, the User will receive confirmation via email and text message.

6.7 Right of Restoration: Users whose access has been disabled due to non-payment may request restoration by paying the outstanding amount along with a prescribed "Restoration Fee." Restoration is subject to technical feasibility. Users acknowledge that live sessions that have already concluded will not be available, but recordings can be accessed, and future sessions may be attended as per the Course schedule.

7. Refund Policy

7.1 Payment Failures

If a payment made through a third-party gateway fails but the amount is debited from your bank account, the deducted amount will be automatically refunded to the same account within 14 days, subject to reconciliation, in accordance with the terms of the third-party payment gateway.

7.2 General Refund Policy

Refunds will not be issued for successful transactions through the payment gateway, except as specifically outlined below.

7.3 Course Subscription Refunds

Users who discontinue their course subscription for any reason are generally not entitled to a refund, including payments made for study materials, e-books, add-on courses, or other related services. However, an exception applies in the following cases:

Since enrollment in a course prevents Root Support Academy from offering that seat to another user, no refunds will be provided beyond the timeframes mentioned above.

7.4 Third-Party Payment Gateway Issues

Root Support Academy is not responsible for any issues related to third-party payment gateways. For problems such as multiple debits or unsuccessful transactions, users must directly contact the third-party gateway provider or their respective bank/financial institution.

7.5 Final Terms

No refunds will be issued beyond those specified in this policy. Any refund granted under the above terms is also subject to the user’s compliance with all other Terms of Service.

8. Termination and Consequences of Termination

8.1 We reserve the right to immediately terminate or suspend your Account and withhold or suspend any Services at any time, in addition to pursuing any legal remedies available to us, if:

(i) You fail to comply with these Terms of Service, including but not limited to defaulting on or failing to pay the applicable Course Fee (or any portion or installment thereof) as outlined in Clause 6.4.

(ii) You provide inaccurate, fraudulent, outdated, or incomplete information during Account registration.

(iii) You violate any applicable laws, regulations, or third-party rights.

(iv) We determine in good faith that terminating or suspending your Account or discontinuing Services is reasonably necessary to protect the safety or property of:

(a)Root Support Academy,

(b)Other Users of the Site, Application, or Services, or

{c}Third-party service providers of Root Support Academy.

8.2Additionally, we reserve the right to review your Account periodically for fraud prevention, risk assessment, security, or investigative purposes. If a violation of these Terms of Service results in civil or criminal liability under applicable laws, we may disclose your Account information if required by a government or legal authority.

9. Miscellaneous

9.1 Indemnity

You agree to indemnify and hold harmless Root Support Academy, including its directors, employees, and officers, from any claims, damages, losses, liabilities, or costs arising from:

9.3 Entire Agreement

These Terms of Service, along with any additional guidelines applicable to the Site, Application, or Services as notified by us, constitute the complete agreement between you and Root Support Academy. In case of any discrepancies between these Terms of Service and other policies regarding your use of the Site, Application, or Services, these Terms of Service shall take precedence.

9.4 Assignment

You may not assign or transfer your rights or obligations under these Terms of Service to any third party. However, Root Support Academy may freely transfer its rights and obligations without requiring your consent.

9.5 Severability

If any provision of these Terms of Service is deemed unenforceable by a court of competent jurisdiction, it will be enforced to the maximum extent possible, while the remaining provisions shall continue in full force and effect.

9.6 Waiver

Failure by Root Support Academy to enforce any provision or right under these Terms of Service does not constitute a waiver of that provision or right.

9.7 Relationship

Your use of the Site, Application, or Services does not establish any employment, agency, partnership, joint venture, or franchise relationship with Root Support Academy.

9.8 Acknowledgment

By accessing and using the Site, Application, or Services, you confirm that you have been given a reasonable opportunity to review these Terms of Service before accepting them.

9.9 Governing Law & Jurisdiction

These Terms of Service are governed by the laws of India. Any disputes arising from these Terms shall be subject to the jurisdiction of courts in Karnataka.

9.10 Modifications

We reserve the right to modify these Terms of Service at any time. Updates will be made available on the Site, and you are responsible for reviewing them periodically. Upon any modifications, your continued use of the Site, Application, or Services shall be subject to the updated Terms of Service.

10. Disclaimer

10.1 Root Support Academy shall not be held liable for any inability to access or use the Site, Application, or Services (in whole or in part) due to circumstances beyond its reasonable control. This includes, but is not limited to, acts of civil or military authorities, natural disasters such as floods, fires, or epidemics, war, riots, or any other unforeseen events.

10.2 Under no circumstances shall Root Support Academy be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, losses related to profits, goodwill, or any other intangible harm arising from your access to, use of, or inability to access or use the Site, Application, or Services. This applies regardless of whether the claim is based on warranty, contract, tort (including negligence), statute, or any other legal theory, and regardless of whether Root Support Academy was advised of the potential for such damages.

10.3 Your ability to access or use the Site, Application, or Services depends on the accuracy and truthfulness of the information you provide. Root Support Academy shall not be responsible for any inaccuracies, falsehoods, or misleading details in the information you submit, nor for any consequences arising from such inaccuracies that affect your registration or continued eligibility to use the Site, Application, or Services.
